What is a Controlled Waste Transfer Note?

Controlled Waste Transfer Notes ('CWTN') documents the legal transfer of specific non-hazardous wastes (like construction debris, certain electrical items, wood) within the UK, promoting responsible disposal and ensuring accountability throughout the waste journey.

These are legally kept on file and accessible for 3 years. They are an essential aspect of waste management in the United Kingdom.

They allow accurate recording if you produce, transport or manage hazardous waste within a commercial environment and must follow all the legal rules of the control system set out by the UK government.

These CWTN's refer to the legal responsibility placed on individuals and organisations to ensure that the transfer of controlled waste is carried out in a safe and environmentally responsible manner.

They are typically produced as carbonless NCR (No Carbon Required) forms, with multiple copies for each party involved in the waste transfer.

The Controlled Notes may also include information about the disposal or treatment of the waste, as well as any hazardous properties of the waste. They may also include guidance and instructions for the safe handling and disposal of the waste.

This duty encompasses various activities, including collection, storage, transportation, and disposal of controlled waste.

When do you need to use Controlled Waste Transfer Notes?

These are required for all movements of Controlled, hazardous waste materials within the UK, including:

  • Whenever Controlled waste leaves your business premises
  • During collections by authorised waste carriers
  • When delivering controlled waste to UK Recycling centres or official landfills
  • During temporary waste transfer arrangements e.g. skip hire
  • Collections from commercial businesses by registered waste carriers
  • Movements from one building to another within the same company
  • Movements from a customer's premises, where another company has produced the waste

Who uses Controlled WTNs?

They are used by anyone in the UK who produces, handles, or disposes of controlled waste, including businesses, local authorities, and individuals.

These include construction companies, manufacturing facilities, healthcare providers, businesses in the hospitality sector, and waste carriers transporting Controlled waste between sites.

Each industry has its unique waste management needs, and specialised waste transfer services play a crucial role in meeting these requirements.

What is their purpose?

The purpose of this legislation is to prevent pollution, protect human health, and safeguard the environment from the adverse impacts of improper waste management practices.

What is the DIFFERENCE between a Waste Transfer Note ('WTN') and a Controlled Waste Transfer Note ('CWTN')?

Waste type: CWTNs adhere to stricter Duty of Care regulations compared to standard WTNs.

Regulations: CWTNs adhere to stricter Duty of Care regulations compared to standard WTNs.

Information captured: CWTNs require more detailed waste descriptions and specific disposal information.

Remember: Always confirm if your waste falls under the Controlled waste category before using a CWTN. Incorrect documentation can lead to penalties.

What features do Duty of Care: Controlled Waste Transfer Notes have?

It must legally be completed and signed by the person handing over the waste, plus the person receiving the waste.

Information must be on the Controlled Waste Transfer Note allowing it to be safely handled and disposed of legitimately within the UK. Prosecution could occur from the British courts if you have mismanaged your waste records.

These CWTN forms contain:

  • Processes that the waste may have been through
  • Good description of what the waste actually is
  • What it is contained or packaged in
  • Quantity of waste within that container or packaging
  • Time, Date and Place of the waste transfer occurring
  • Full details of receiver's licence or exemption
  • Full details of carrier's licence and registration number
  • In N.Ireland, post-Brexit, special rules apply that a Carrier must also include a Statement of having applied a hierarchy to the waste transfer
  • Confirmation that Carrier is legally registered as a carrier of Controlled Waste
  • The "SIC" Standard Industry Code of your UK business
